1. Identification of the service

Odalon is a digital service accessible mainly through odalon.com and chat.odalon.com. For the purposes of these terms, references to “Odalon,” “the service,” “we,” or “the platform” shall be understood as references to the Odalon service.

2. Acceptance of the terms

By accessing, registering for, or using Odalon, you accept these terms of service and agree to use the platform lawfully, responsibly, and in accordance with applicable regulations.

If you do not agree with these terms, you must not use the service. The use of certain features may require the creation of an account and acceptance of additional conditions where applicable.

3. Purpose and nature of Odalon

Odalon provides assistance through artificial intelligence to help users make queries, obtain explanations, analyze scenarios, and receive preliminary guidance on matters related to cybersecurity, technology, digital risks, and good practices.

The responses generated by Odalon are informational and supportive in nature. They do not constitute professional advice, a formal audit, security certification, a definitive technical opinion, legal advice, or a substitute for the judgment of qualified specialists.

4. Registration and user account

To use certain Odalon features, it may be necessary to create an account. The user agrees to provide truthful, up-to-date, and sufficient information for use of the service.

The user is responsible for maintaining the confidentiality of access credentials, protecting the account, and any activity carried out through it. If you detect unauthorized use or suspect that your account may have been compromised, you must notify support@odalon.com as soon as possible.

5. Permitted use of the service

The user agrees to use Odalon only for lawful and legitimate purposes compatible with the purpose of the service. Odalon may be used for learning, defensive analysis, review of good practices, technical guidance, documentation, preparation of internal procedures, and support in professional or educational tasks.

The user must ensure that they have sufficient authorization to analyze any system, file, data, infrastructure, or information entered into the platform.

6. Prohibited uses

It is prohibited to use Odalon for unlawful, abusive, harmful, or bad-faith purposes. In particular, the service may not be used to:

• Access, attempt to access, or facilitate unauthorized access to systems, accounts, networks, devices, or third-party data.
• Develop, improve, automate, or execute malware, ransomware, phishing, control evasion, unauthorized exploitation, or any unlawful offensive activity.
• Infringe third-party rights, including privacy rights, intellectual property, trade secrets, or confidentiality.
• Enter personal, confidential, or sensitive data without a legal basis, sufficient authorization, or adequate protection measures.
• Attempt to circumvent technical limitations, security mechanisms, access controls, usage restrictions, or payment systems.
• Use the service in a way that may affect its availability, integrity, security, or proper operation.

Odalon may limit, suspend, or cancel access for users who breach these terms or use the service in an abusive, fraudulent, unlawful, or harmful manner.

7. Content entered by the user

The user retains, where applicable, the rights that correspond to them over the texts, files, queries, documents, or materials entered into Odalon. By using the service, you authorize Odalon to process such content to the extent necessary to provide the requested features, generate responses, maintain the account, apply security measures, and provide support.

The user declares that they have the rights, permissions, or legal bases necessary to enter, upload, or process such content on the platform. Odalon accepts no responsibility for content provided by the user or for the use the user makes of generated responses.

8. Results generated by artificial intelligence

Responses generated by Odalon may contain errors, inaccuracies, omissions, or incomplete information. The user must review, compare, and validate any result before applying it in real environments, especially where it may affect security, regulatory compliance, business continuity, relevant technical decisions, or third-party data.

Odalon does not guarantee that responses are accurate, complete, up to date, suitable for a specific case, or free from errors. The use of responses is the responsibility of the user.

9. Plans, payments, and subscriptions

Odalon may offer a free plan and paid plans, including the Pro plan. The applicable conditions, features, limits, and prices will be shown on the corresponding page before purchase.

Unless otherwise stated, the Pro plan is recurring on a monthly basis. Payments may be processed by external payment providers, such as Stripe, in accordance with their own terms and policies.

The user is responsible for keeping payment information up to date and cancelling the subscription if they do not want it to renew. Features associated with a paid plan may be limited or suspended if payment is not completed correctly.

10. Cancellation and plan changes

The user may manage or cancel the subscription through the options enabled in the account or through the billing portal when available. Cancellation prevents future renewals but does not necessarily imply a refund of amounts already accrued, unless applicable regulations provide otherwise or another policy is expressly indicated.

Odalon may modify, expand, or reduce the available plans, their limits, features, or prices. When a change materially affects an active subscription, the user will be informed by reasonable means.

11. Availability and modifications to the service

Odalon endeavors to keep the service available and operational, but does not guarantee uninterrupted availability, absence of errors, or permanent compatibility with all devices, browsers, or configurations.

We may modify, update, suspend, or interrupt all or part of the service for technical, security, legal, operational, or improvement reasons. Where reasonably possible, efforts will be made to minimize the impact on users.

12. Intellectual property

Odalon, its design, brand, interface, texts, logos, structure, software, and other proprietary elements of the service are protected by intellectual and industrial property rights or other applicable rights.

Use of the service does not grant the user any ownership rights over Odalon, its technology, brand, or distinctive elements. It is not permitted to copy, modify, distribute, sell, sublicense, or commercially exploit Odalon’s proprietary elements without express authorization.

13. Data protection

The processing of personal data arising from the use of Odalon is governed by our Privacy Policy, which forms part of the legal information applicable to the service.

14. Limitation of liability

To the fullest extent permitted by law, Odalon shall not be liable for indirect damages, loss of profits, loss of data, business interruptions, reputational damage, decisions made by the user based on AI-generated results, or consequences arising from incorrect, unauthorized, or contrary use of these terms.

Nothing in these terms shall exclude or limit liabilities that cannot be excluded or limited under applicable regulations, including those that legally correspond to consumers and users where such regulations apply.

15. Suspension or cancellation of accounts

Odalon may suspend or cancel an account where there are reasonable indications of a breach of these terms, fraudulent use, abuse of the service, security risk, non-payment, legal requirement, or the need to protect other users, third parties, or the platform itself.

The user may request deletion of the account through the options available on the platform or by contacting support. Deletion may be subject to the retention of certain information where necessary due to legal obligations, fraud prevention, security, or the defense of claims.

16. Changes to these terms

Odalon may update these terms to adapt them to legal, technical, operational, or commercial changes. When the changes are relevant, efforts will be made to inform users by reasonable means, such as a notice on the platform or an email communication.

Continued use of the service after the changes take effect shall imply acceptance of the updated terms, unless applicable regulations require express acceptance.

17. Applicable law and jurisdiction

These terms shall be governed by Spanish law, without prejudice to any rights that may correspond to consumers and users under mandatory applicable regulations.

For any dispute related to the service, the parties shall submit to the courts and tribunals that have jurisdiction under applicable regulations.
